Justice Restored: What We’ve Learned Pursuing Sexual Assault Claims Through Lookback Windows

Recently, many states and local governments have revived otherwise barred civil claims based on sexual assault by enacting what are known as “lookback windows,”a period during which otherwise barred claims can be brought. Given these claims arise from incidents which often occurred decades in the past, they present unique situations and lessons to be learned, including the long-term impact that sexual assault has on a survivor’s life.
This workshop, presented by Fierberg National Law Group, will address those lessons learned from such cases. It will also explore the unique opportunities these cases provide for unique creative and strategic forms of advocacy and the challenges these cases can present. Lastly, it will address to policy reasons for lookback windows and why they are crucial to achieving justice, and it will provide an update on the status of lookback windows around the country. It will further discuss notable cases brought under lookback windows and their effects on the legal landscape.
